Acceptable Use Policy

This Acceptable Use Policy (the "AUP") governs your use of the services provided by Bizangle, LLC ("Bizangle," "we," "us," "our"), including the Bizangle platform, mobile app, APIs, voice services, messaging services, and any related products (collectively, the "Service"). This AUP is incorporated into our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms.
Violation of this AUP is a material breach of the Terms and may result in immediate suspension or termination of your account without notice and without refund.
1. General Rules
You will not use, and you will not permit any third party to use, the Service to:
- violate any law, regulation, court order, or governmental request;
- infringe, misappropriate, or violate any intellectual-property, publicity, privacy, or contractual right;
- impersonate any person or entity, or misrepresent your affiliation;
- engage in fraud, deception, or theft; or
- harass, threaten, defame, stalk, or harm any person.
2. Telephone and SMS Use — TCPA and CAN-SPAM Compliance
The Service can place phone calls and send SMS messages. You are solely responsible for compliance with all applicable telecommunications and anti-spam laws. You must not:
- place calls or send SMS without the consent legally required by the recipient's jurisdiction, including the U.S. Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and implementing FCC regulations;
- call or text any number listed on the U.S. National Do-Not-Call Registry or an applicable state Do-Not-Call list unless an exemption applies;
- place auto-dialed calls, artificial- or prerecorded-voice calls, or robocalls to mobile phones without prior express written consent;
- send commercial SMS without prior express written consent, functional opt-out instructions ("Reply STOP to unsubscribe"), and clear identification of the sender;
- spoof, falsify, or obscure caller-ID or sender information (except as expressly permitted by FCC rules for legitimate purposes);
- send messages that violate the CAN-SPAM Act, 15 U.S.C. § 7701 et seq., or any state equivalent;
- use the Service for political solicitation, debt collection, unsolicited marketing, survey-dialing, or lead-generation outreach that does not comply with the TCPA, FCC rules, and applicable state laws;
- call or message individuals in jurisdictions requiring opt-in consent (including GDPR countries) without obtaining that consent;
- use the Service to violate carrier policies (including 10DLC registration requirements for A2P SMS in the United States);
- record a call in any jurisdiction without the consent required by that jurisdiction (many U.S. states and non-U.S. jurisdictions require all-party consent).
2.1 Consent and Records
You must maintain records of all consents and opt-outs and produce them to Bizangle within five (5) business days of request. Failure to do so is grounds for immediate suspension.
2.2 Opt-Out Processing
You must honor opt-out requests within the time required by law (immediately for SMS "STOP"; within 10 business days for email/call under CAN-SPAM) and synchronize opt-outs across all channels.
3. Prohibited Content
You will not use the Service to create, transmit, store, or share content that:
- is unlawful, defamatory, obscene, pornographic, sexually explicit, or sexually suggestive involving minors;
- promotes violence, self-harm, suicide, or terrorism;
- contains hate speech or incites discrimination or violence on the basis of race, ethnicity, religion, sex, gender identity, sexual orientation, disability, or other protected characteristic;
- promotes, facilitates, or describes the manufacture, sale, or distribution of illegal drugs, firearms, explosives, or weapons regulated by law;
- promotes gambling in jurisdictions where it is unlawful;
- constitutes fraud, scams, phishing, or social engineering;
- infringes copyright, trademark, trade secret, or other intellectual-property rights;
- contains malware, viruses, worms, Trojan horses, ransomware, or other malicious code;
- contains protected health information (PHI) regulated by HIPAA, unless a Business Associate Agreement has been executed with us [REVIEW: we do not currently sign BAAs — confirm policy]; or
- contains classified, export-controlled, or otherwise legally restricted information you are not authorized to disclose.
4. Prohibited Activities
You will not:
- attempt to gain unauthorized access to the Service, other users' accounts, or any system or network;
- probe, scan, or test the vulnerability of any system or network without written authorization;
- bypass, disable, or interfere with security or authentication features;
- use automated means to access the Service in a manner that degrades performance or exceeds rate limits;
- reverse engineer, decompile, or disassemble any portion of the Service;
- resell, lease, sublicense, or white-label the Service without our prior written consent;
- use the Service to benchmark or build a competing product;
- send chain letters, pyramid schemes, Ponzi schemes, or multi-level-marketing communications;
- interfere with any other user's use of the Service; or
- knowingly allow or enable any of the above by a third party.
5. AI-Specific Restrictions
You will not use AI features of the Service to:
- generate content that violates Section 3;
- attempt to extract training data, prompts, or weights from underlying models;
- represent AI-generated content as human-generated in a context that deceives consumers (including for political speech, where disclosure may be required by law);
- create deepfakes, voice clones, or impersonations of a real person without that person's explicit consent;
- produce non-consensual intimate imagery or sexualized depictions of any identifiable person;
- generate content designed to evade automated content-moderation systems;
- produce personalized medical, legal, financial, or psychiatric advice represented as professional advice; or
- make automated decisions that have legal or similarly significant effects on an individual (credit, housing, employment, insurance) without appropriate human review.
6. Network and Resource Abuse
You will not:
- generate traffic that materially exceeds your plan's fair-use limits;
- engage in denial-of-service, brute-force, or flood-style activity;
- intentionally transmit malformed or oversized packets;
- use the Service as part of a botnet or command-and-control infrastructure; or
- consume excess resources in a way that degrades service for other users.
7. Reporting Abuse
If you believe someone is using the Service in violation of this AUP, contact us at support@bizangle.com with as much detail as you can provide (phone number, conversation ID, timestamps, screenshots). We investigate credible reports promptly.
8. Our Response to Violations
We may, in our sole discretion:
- warn you and require remediation within a specified timeframe;
- throttle, rate-limit, or restrict your account;
- remove or disable offending content;
- suspend or terminate your account;
- report violations to law enforcement, regulators, or affected third parties; and
- cooperate with investigations, subpoenas, or court orders.
We are not obligated to provide prior notice for violations that involve illegal activity, imminent harm, network abuse, or a material threat to the Service.
9. Updates to This AUP
We may update this AUP from time to time. The "Last Updated" date reflects the most recent change. Continued use of the Service after an update constitutes acceptance.
